a. Agreement to Terms By accessing or using our website, ETFaction.com (the “Site”), our desktop optimized web platform (the “Platform”), or any other services provided by us (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Services.

b. Scope of Services These terms govern your access to and use of all ETFaction.com services, which include:

  • The Site: Our public-facing website featuring AI-assisted, data-driven insights, articles, and thought leadership.
  • The Platform: Our gated, desktop-optimized web platform providing datasets, interactive tools, and professional-grade reporting for registered and subscribed users.

d. Use of the Site and Platform

e. Desktop Platform Accounts

  • Registration: To access the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep this information updated.
  • Account Security: You are responsible for safeguarding your account password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
  • Subscriptions and Fees: Access to certain features of the Platform is available only through a paid subscription.
    • Billing: You will be billed in advance on a recurring and periodic basis (such as monthly or annually), depending on the subscription plan you select.
    • Automatic Renewal: At the end of each billing cycle, your subscription will automatically renew under the same conditions unless you cancel it or we cancel it. You may cancel your subscription renewal through your online account management page or by contacting customer support.
    • Fee Changes: We reserve the right to modify subscription fees at any time. Any fee change will become effective at the end of the then-current billing cycle.

For subscribed users of the Platform, termination procedures will also be governed by the terms of your specific subscription agreement.

h. Disclaimers and Limitation of Liability The Services are provided on an “AS IS” and “AS AVAILABLE” basis. Your use of the Services is at your sole risk. Our liability is limited to the maximum extent permitted by law, as detailed in our separate Disclaimer. In no event shall ETF Action’s total liability to you for all damages, losses, and causes of action exceed the amount you have paid us in the last six (6) months, or, if greater, one hundred US dollars ($100).

i. Indemnity You agree to indemnify and hold harmless ETF Action and its officers, directors, employees, and agents from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.
